Terms of Use
These terms are an agreement between you and Bloomrise ("Bloomrise", "we", "us") for the Rogo iOS app and its games, including the Rogo Pro subscription (together, "Rogo"). By creating an account or using Rogo you agree to them. Apple's Licensed Application End User License Agreement also applies; where it conflicts with these terms, these terms apply to the extent permitted.
1. Who can use Rogo
You must be at least 13 years old (or older if your country requires it for online services) to create an account. If you are under 18, a parent or guardian must agree to these terms for you and supervise your play.
2. Your account
Rogo requires an account, created with an email address and password or with Sign in with Apple. Keep your sign-in details private; you are responsible for activity on your account. Give us accurate information and use one account per person. You can delete your account at any time from Settings in the app.
3. Free runs and Rogo Pro
- Every account includes two free runs. After that, playing requires a Rogo Pro subscription.
- Rogo Pro is an auto-renewing subscription available monthly or yearly. The price is shown in the app before you buy and is charged to your Apple ID at confirmation of purchase.
- Your subscription renews automatically for the same period unless you cancel at least 24 hours before the end of the current period. Manage or cancel it in iOS Settings → your name → Subscriptions. Deleting the app or your account does not cancel the subscription.
- Payments, refunds and billing disputes are handled by Apple under Apple's terms. We cannot issue refunds directly.
- Prices may change; Apple will notify you in advance and give you the chance to cancel before a new price applies.
- Use restore purchases in the app to recover an active subscription on a new device signed in with the same Apple ID.
4. Play safely
Rogo involves physical activity: jumping, squatting, stepping and moving your arms. Before playing, make sure you have enough clear space around you, a non-slip surface, good lighting and a secure place for your phone. Stop immediately if you feel pain, dizziness, shortness of breath or discomfort. If you have a medical condition, are pregnant, or are unsure whether exercise is appropriate for you, talk to a doctor first. Rogo is a game, not a medical or fitness advisory service, and it does not monitor your health. You play at your own risk and are responsible for playing within your abilities.
5. Acceptable use
You agree not to copy, modify, reverse engineer or redistribute Rogo; interfere with or disrupt the service; circumvent free-run limits, subscriptions or security measures; use Rogo for anything unlawful; or use automated tools to access it. We may suspend or close accounts that break these rules.
6. Ownership
Rogo, its games, graphics, characters, sounds and code belong to Bloomrise and its licensors and are protected by copyright and other laws. We grant you a limited, personal, non-exclusive, non-transferable licence to use Rogo on Apple devices you own or control, subject to these terms. Feedback you send us may be used without obligation to you.
7. Changes to Rogo
We may add, change or remove games and features, and we may update, suspend or discontinue Rogo at any time. We will try to give notice of material changes that affect an active subscription.
8. Privacy
Our Privacy Policy explains what information Rogo handles, including how the camera is used. It is part of these terms.
9. Disclaimers
Rogo is provided "as is" and "as available". To the fullest extent permitted by law, we disclaim all warranties, express or implied, including fitness for a particular purpose, and we do not promise that Rogo will be uninterrupted, error-free, compatible with every TV or device, or that body tracking will always be accurate.
10. Limitation of liability
To the fullest extent permitted by law, Bloomrise and its team will not be liable for any indirect, incidental, special, consequential or punitive damages, or for personal injury or property damage arising from physical activity while playing, and our total liability for any claim relating to Rogo is limited to the amount you paid us for Rogo in the twelve months before the claim. Some jurisdictions do not allow these limits, so they may not apply to you.
11. Termination
You may stop using Rogo and delete your account at any time. We may suspend or terminate your access if you violate these terms or if we discontinue Rogo. Sections 6, 9, 10 and 12 survive termination.
12. General
These terms are governed by the laws of the United States and of the state in which Bloomrise is established, without regard to conflict-of-law rules, and disputes will be brought in the courts located there unless local consumer law gives you other rights. If any part of these terms is unenforceable, the rest remains in effect. These terms, together with the Privacy Policy and Apple's EULA, are the entire agreement between you and Bloomrise regarding Rogo. Apple is not responsible for Rogo or for addressing claims relating to it, and Apple and its subsidiaries are third-party beneficiaries of these terms as required by Apple.
13. Changes to these terms
We may update these terms. The new version will be posted here with a new effective date, and continued use of Rogo after that date means you accept it.
